Violent Sydney Gang Rapists

A court has lifted restrictions on the reporting of the number of offences and victims of four brothers who are probably Sydney’s most violent gang rapists.
More than three years after their first offences, a court allowed the reporting of the crimes in which women as young as 13 were lured to their Ashfield home and then gang raped.

Three of the four brothers from Pakistan - known only as MSK, MAK, MRK and MMK - are still to be sentenced later this year after the final trial concluded on Monday, when MSK pleaded guilty to one charge of aggravated sexual assault.

The media had been banned from reporting the back-to-back trials, which ran between September 2003 and this month, for fear of prejudicing a jury.

At least six girls were raped in the Ashfield home between January and July 2002.

Two of the Sydney brothers, MSK and MAK, raped a 14-year-old girl at their Ashfield home on June 14, 2002. Another brother, 19-year-old MMK, was acquitted.

The three brothers originally stood trial together in the NSW Supreme Court, accused of gang rape.

But Justice Peter Hidden granted MMK and MAK separate trials after MSK announced to the jury that he and his brothers were convicted gang rapists serving jail time.

The trial of MSK continued with Crown Prosecutor Ken McKay telling the court the girl, known as T, was plied with alcohol before she was raped in a bedroom by the brothers.

Mr McKay said there was an agreement that "whoever wanted to have sexual intercourse with her among the brothers could have it".

The jury convicted 26-year-old MSK on four charges of aggravated sexual assault in company.

MAK, 25, pleaded guilty to sexual intercourse without consent with a minor.

Unlike his brothers, there was no DNA evidence linking MMK to the assault on T.

Justice Hidden said the evidence "gives rise to strong suspicion that [MMK] sexually assaulted T", but found him not guilty after a trial without a jury.

The judge today lifted an order suppressing details of the offences after MSK pleaded guilty to another rape, that of a 13-year-old girl.

The court heard MSK raped her after she had consensual sex with MMK at their Ashfield house on July 14, 2002.

MSK pleaded guilty to aggravated sexual assault, while MMK pleaded guilty to having sexual intercourse with a girl under 16.

MSK, MMK and MAK are already serving lengthy jail terms for the gang rape of two other girls aged 16 and 17 a fortnight after the attack on the 13-year-old.

The schoolfriends were repeatedly raped at knifepoint at the Ashfield house and told they would be killed.

Along with brother MRK and a friend known as RS, the three became the first in NSW to be convicted of aggravated sexual assault in company, which carries a maximum life sentence.

MSK, MAK, MMK and MRK received maximum jail terms ranging from 22 to 10 years for the attack.

RS took his own life in prison before sentencing. (Good News)

Justice Hidden will sentence the brothers for the other offences in October.

The punishment should fit the crime, life in prison or death.
