Man Denies Sydney Gay Murder

The court will hear evidence that he was stabbed in the neck by Trent Jennings, 20, who today stood trial in the NSW Supreme Court for the murder of Mr Vitale at Narwee, in Sydney’s south, on December 30, 2003

Jennings does not dispute that he fatally stabbed 32-year-old Mr Vitale but has pleaded not guilty to murdering him.

The crown would not accept Jennings’ guilty plea to manslaughter, which was to be made on the grounds that he had been suffering from a mental illness at the time.

However his lawyer Paul Winch said it was open to Justice David Kirby, who is presiding over the trial without a jury, to find Jennings not guilty of murder because of mental illness.

The court was told that Jennings met Mr Vitale in an internet chat room and they arranged to meet for sex.

Crown Prosector Paul Lynch said Mr Vitale drove to the Narwee flat where Jennings was staying and the pair went to a park where they had a sexual encounter.

But during the encounter, Jennings had claimed, he became concerned he was going to be raped, despite Mr Vitale having being tied up as part of their sex play.

Mr Lynch told the court that Jennings had then stabbed Mr Vitale in the neck.

"Mr Jennings told police he freaked out, was fearful for his safety and he believed Mr Vitale was about to rape him," Mr Lynch said. "He got the knife and stabbed Mr Vitale and left the scene."

Mr Lynch said Jennings had taken a backpack with him to the park containing condoms, lubricant, nylon rope, a knife and a bottle of amyl nitrate.
