Australia Bans Mobile Phone Porn

PHONE companies are banned from offering hard-core porn services over mobiles through new regulations for services carrying a premium price tag
The Australian Communications Authority said content classified X18+ or refused classification has been banned altogether. The new rules mean services providing content rated MA15+ or R18+ will be required to use special 195 or 196 numbers and restrict access to prevent minors seeing the material.

The means of restriction would be left to the carriers, ACA content manager Vince Humphries said. The restrictions also apply to content operator-operated portals, such as Telstra’s i-mode or Optus’ Zoo, but only where the carrier charges extra to access the material, he added.

However, services provided at the same rate as normal MMS or SMS messages, or data download tariffs, were outside the scope of the regulations. Mr Humphries said such content instead came under the industry code registered by the Internet Industry Association.

The Playboy material offered by Hutchison’s 3 had been the subject of discussions between the carrier and regulators, and appeared to comply with the new rules, Mr Humphries said.

Representing the carriers, the Australian Mobile Telecommunications Association said it would ensure its members properly informed subscribers of the costs of premium rate services.

It would also ensure that such services came with various features, including a fast unsubscribe "stop" command, to allow subscribers to control the service. Access control and age verification measures would also form part of the scheme, AMTA said.

"Age-restricted premium messaging services will not be available until the industry and regulators ensure that all consumer protection measures are in place," it said.

Mr Humphries said the ACA would introduce a compliance scheme that would force carriers to detail how they complied with regulations.
